Liquor Licensing

A licence is required for the retail sale of alcoholic liquor and the administration of liquor licensing in Scotland is entrusted to Licensing Boards.

A new licence may have to be granted in respect of premises licensed for the first time. There can be the transfer of a licence from an existing licensee to a new licensee, firstly temporarily and thereafter a permanent application can be made.

The licensing legislation stipulates the normal hours during which liquor can be sold and it is often necessary to apply for an extension to these hours to the Licensing Board. Your solicitor can act for you in any of the licence applications. It is very important that these applications are lodged before the last day for lodging applicable to that quarterly Licensing Board meeting.

If there have been any objections made to the Board for the renewal or extension of a licence then it is important that you have representation at the quarterly Licensing Board meeting where the application is being considered. Your solicitor can act on your behalf in this event.

The registration of a Club also requires to go before the Licensing Board prior to going to the Sheriff Court and again your solicitor can ensure the correct procedure is followed.
