Coronavirus Pandemic - Can I Still Enter into a Will?

We advise clients of all ages and stages in life to ensure that they have a Will in place to protect them, and their loved ones, upon their death.  The current Coronavirus pandemic, and the understandable concern that this is causing, has resulted in an increase in queries from clients looking to put in place a Will, or update an existing Will.

Whilst we would normally meet with a client face to face (either in the office or their own home) to take instructions and thereafter carry out the signing and witnessing of the Will, the current movement restrictions and physical closure of our offices prohibits us from doing that.  However, we are still able to assist clients during this difficult time by taking instructions by telephone/video-call, drafting and sending the Will by post or email, and thereafter witnessing the client’s signature where necessary, using video-call.

When a Will is signed, the granter must sign each page of the Will, and their signature must be witnessed on the last page. It is advisable that the witness is not someone who is named in the Will (i.e. not a beneficiary). We understand that this can present an issue for clients in the current lockdown, where they either live alone and can’t have a visitor into their home to witness their signature, or perhaps they live with their spouse/partner who is named in the Will and therefore cannot witness their signature.

Our lawyerscan witness a client’s signature by sending the principal document in the post (or by email for you to print off yourself at home), once instructions have been taken and the draft has been discussed and agreed.  We can then arrange a video call, where the solicitor can witness the client signing the Will. The Will can then be returned to the solicitor who can, on receipt of the signed will, legitimately sign and complete the signing details.
