Instruction Of Free Personal Care For Adults Under The Age Of 65

The 1 April, 2019 saw the implementation of “Frank’s Law” in Scotland, which has extended free personal care to adults under the age of 65 who are deemed to require it. Free personal care has been in place since 2001 for adults over the age of 65. The types of personal care provided will vary according to an adult’s assessed care needs, but often include care in relation to bathing and showering, assistance with the preparation of food and eating, and assistance with dressing, getting up and going to bed.

“Frank’s Law” came about as a result of a campaign by Amanda Kopel, whose husband was diagnosed with dementia at the age of 59. He was deemed too young to qualify for free personal care. Mrs Kopel believed that the law was discriminatory and she petitioned MSPs to move for free personal care to be extended to those under the age of 65. Mrs Kopel’s aim was to ensure that anybody who lived with disabilities and degenerative conditions could access support, regardless of their age. Mrs Kopel first petitioned the Scottish Ministers in 2013 and continued her campaign following the death of her husband Frank, just 19 days after his 65th birthday. The Scottish Government envisages that around 10,000 will be entitled to free personal care and “Frank’s Law” will ensure that people who require personal care are treated equally regardless of their age.

It is up to each local authority to carry out assessments of a person’s needs and to provide such services as that person is deemed to require.
