Administering an Executry

In Scotland, the administration of an executry estate is a process that follows the passing of an individual, involving the settlement of their affairs and distribution of their assets. The term "executry" refers to the legal process of executing someone's Will, ensuring that their wishes are carried out in accordance with the law.
One of the initial steps in the administration process is obtaining confirmation, which is the Scottish equivalent of probate in other jurisdictions. Confirmation is a legal document issued by the court that confirms the validity of the deceased person's Will and grants authority to the executor (or executors) to administer the estate. If there is no valid Will, an executor may need to be appointed by the court.

Our next Ask the Expert session will discuss the process of obtaining confirmation in Scotland and will be held on 27 February 2024 by our local expert Lindsay Nicholas.
